Section 494
Circumstances in which liability is created

(1) The liability under section 493 shall be created and sustained as follows:-
(a) Law,
(b) Covenant,
(c) Indirect or Quasi Contract
(d) Unjust enrichment (e) a unilateral undertaking by a person to undertake an obligation,
(f) Acts which are considered torts according to the law,
(g) Acts which are considered semi-criminal acts according to the law.
(2) of sub-section (1),–
(a) The obligation under clause (a) shall be maintained in accordance with this Code or other laws.
(b) The obligations under Clause (b) shall be maintained according to the agreement concluded between the parties.
(c) The obligation as per Clause (c) shall be maintained in accordance with the indirect or quasi contract defined as per paragraph-15 of this part.
(d) The liability as per Clause (d) shall be maintained in accordance with the unfair enrichment defined as per paragraph-16 of this part.
(e) The liability under Clause (e) shall be determined in accordance with the provisions on the creation of liability in accordance with the law by the unilateral commitment of a person.
(f) The liability as per clause (f) shall be sustained from the torts defined as per paragraph-17 of this part.
(g) The liability as per clause (g) shall be sustained by defective product as defined in paragraph-18 of this part or other act which is considered as semi-delict according to the law.
